Starting Probation
:Your day in court
The following will give you an idea of what procedures you will be facing when you have your day in court:
For your day in court please dress nicely (no revealing clothing, no shorts, tank tops, etc.). You will appear in court, with or without your attorney. If your case is resolved by you being placed on Community Supervision (probation), you will go over some documents with your attorney. You will sign those documents and your thumbprint will be placed on the order. Those documents will include the judgment which has your conditions of supervision listed on it.
The Judge will call you to the bench and ask what has been worked out on your case. The Judge will accept the plea bargain for probation (if that is what you have decided) and you will be told to see the Court Officer. You will be given instructions on where to go (the Judicial Compliance Department) to take care of payment arrangements for fines, court costs and/or court appointed attorney fees. The Court CSO will also give you initial reporting instructions.
You need to take the documents you received in court with you to the Judicial Compliance Department which is on the 4th floor in room 410 of the courthouse. The Judicial Compliance Department will establish, based on a financial evaluation, payment agreements to satisfy the probationer's court-ordered obligation. If determined necessary, a community service agreement will be established in lieu of a payment agreement, in which the probationer will perform community service work for the Lubbock County Maintenance Department to satisfy their obligation to the court. The Judicial Compliance Department establishes and monitors the agreements for compliance and until either the probationer satisfies the agreement or willfully refuses to comply.
After you have met with the Judicial Compliance Department you need to report directly to the Lubbock-Crosby County Community Supervision and Corrections Department (adult probation) at 701 Main. Please do not bring any children with you to this building as sex offenders report here.
Remember, your probation starts today!
Probation intake procedure
After you complete the court process (including setting up your payment agreement with the Judicial Compliance Department) you will report to the Lubbock-Crosby County Community Supervision and Corrections Department (adult probation) at 701 Main Street in Lubbock. Please bring all the paperwork you were given in court and at the Judicial Compliance Department. When you arrive at the department, check in with the receptionist for further instructions. Again, it is highly recommended that children not be brought with you anytime you come to the probation department. They can never be left unattended as sex offenders report to this office.
Please be prepared to be at the probation department for at least 30-45 minutes if you live in Lubbock County. If you reside outside of Lubbock County be prepared to be at the probation department for 1½ to 2 hours in order to process your case for transfer to your county of residence.
You will be asked to complete a data information sheet. Please have the following information with you or bring a completed data sheet from your attorney’s office:
· Driver’s license or valid ID
· Names, phone number and address, for parents and three other references (18 years of age or older) who will know how to contact you at all times.
· Employer’s information (address, phone number and supervisor’s name and number if different from the company’s main number).
· Vehicle information including license plate number.
You will be scheduled to attend a one-time orientation class which is offered on Tuesdays at 2 pm and Fridays at 9:30 am. Please be prepared to choose one of those days. The class lasts 1 hour. You will also be given instructions regarding contacting your officer.
Your Community Supervision Officer (CSO)
Your supervision officer can be very helpful to you. He/she can answer any questions you have about your probation; schedule classes, programs and help you set up appointments you need to fulfill your probation obligations. Your officer can also provide community-based referrals such as drug/alcohol counseling, employment counseling and literacy/GED preparation that will help you prepare for a positive life during probation. If you have needs arise such as needs for clothing or food do not hesitate to ask your officer for referrals in the community. Your officer will supervise you as directed by the Court and will inform the Court as to how you are abiding by the rules. His/her job is to protect the community by seeing you at home or work as well as in the probation office.
Your first visit
Hopefully you have had time to review your judgment and have come up with any questions or concerns you have about your requirements. This is a great time to ask questions and clear up any confusion you have as to what’s expected of you. At your “intake appointment” you will meet with a CSO (community supervision officer) who will go over the terms and conditions of your judgment and answer any questions you have. You will receive information about your requirements such as classes, payments, ignition interlock, etc. You will be interviewed to gather information about you, your background, your friends and family, your employment, health, and other areas of your life such as substance abuse. This information gathering helps to develop a plan to guide your time on probation. After the interview you will be given an appointment for your next visit, you will be directed to register for CSR (community service restitution) and your photo will be taken if it hasn’t been taken yet. Again it is important for you to remember that the terms and conditions (requirements or rules) of your probation started the day you went to court.
